Welcome to Peter Hydorn Photography. These Terms & Conditions govern the use of this website and the purchase or booking of photography, video, editing, drone, commercial, fine-art, and related services provided by Peter Hydorn Photography.

By accessing this website, submitting an inquiry, booking a service, purchasing a product, or otherwise engaging Peter Hydorn Photography, you acknowledge that you have read, understood, and agree to these Terms & Conditions.

1. Services

Peter Hydorn Photography provides professional photography, videography, photo and video editing, drone/aerial imagery, commercial photography, real estate photography, event photography, portrait photography, fine-art photography, prints, and related creative services.

Specific services, deliverables, pricing, timelines, licensing, and usage rights may vary by project and will be outlined in the applicable proposal, invoice, agreement, or written confirmation.

2. Booking & Reservations

A date is not considered officially reserved until the required retainer or deposit has been received and the booking has been confirmed in writing.

Submitting an inquiry does not guarantee availability or reserve a date.

For larger commercial, event, wedding, or production projects, a separate written agreement may be required before work begins.

3. Retainers & Payments

A non-refundable retainer may be required to secure photography, video, or other creative services.

The retainer compensates Peter Hydorn Photography for reserving the date and declining other work for that period.

Remaining balances are due according to the payment schedule stated on the applicable invoice or service agreement.

Failure to make required payments may result in cancellation or suspension of services.

Additional services, overtime, travel, editing, licensing, rush delivery, or requested changes may result in additional charges.

4. Cancellations & Rescheduling

Clients should provide as much notice as reasonably possible when canceling or requesting a change to a scheduled session.

Because scheduled dates represent reserved production time, retainers are generally non-refundable.

Rescheduling may be permitted at the discretion of Peter Hydorn Photography and is subject to availability.

If a client repeatedly reschedules, fails to appear, or cancels with insufficient notice, additional booking fees or a new retainer may be required.

Specific cancellation and rescheduling terms contained in an individual signed contract will supersede these general terms where applicable.

5. Weather & Outdoor Sessions

Outdoor photography and drone services may be affected by weather, lighting conditions, airspace restrictions, safety concerns, or other circumstances outside the photographer's control.

Peter Hydorn Photography may recommend rescheduling when conditions are unsafe or unsuitable for the intended work.

Weather-related rescheduling does not automatically entitle the client to a refund of the retainer.

6. Drone & Aerial Services

Drone services are subject to applicable federal, state, and local laws, regulations, airspace restrictions, property restrictions, weather, and operational safety requirements.

Peter Hydorn Photography reserves the right to decline or modify a drone flight when conditions or regulations make the requested operation unsafe or unavailable.

Drone imagery cannot be guaranteed for a specific location or shot if legal, regulatory, environmental, or safety restrictions prevent the flight.

7. Creative Style & Artistic Judgment

Photography and video contain an element of artistic interpretation.

Clients may communicate preferences, examples, and desired outcomes; however, final creative decisions regarding composition, lighting, editing, color treatment, image selection, and artistic presentation remain with Peter Hydorn Photography unless otherwise agreed in writing.

Every photograph is not guaranteed to meet every subjective preference.

8. Image Selection & Editing

Peter Hydorn Photography may select images for final delivery based on technical quality, composition, artistic considerations, and project requirements.

Unedited, rejected, duplicate, test, or outtake images are generally not provided unless specifically agreed upon.

Editing may include color correction, exposure adjustment, cropping, retouching, and other post-production appropriate to the selected service.

Extensive retouching or additional editing requested after delivery may be subject to additional fees.

9. Delivery

Estimated delivery times vary depending on the type and scope of the project.

Delivery dates are estimates unless a guaranteed delivery date has been expressly agreed to in writing.

Delays caused by circumstances outside the reasonable control of Peter Hydorn Photography will not constitute a breach of these Terms.

Clients are responsible for downloading and safely storing delivered files.

Peter Hydorn Photography is not responsible for the permanent storage of delivered files and recommends that clients maintain their own backups.

10. Copyright & Ownership

Unless otherwise agreed in writing, copyright in photographs, video, artwork, and other original creative works remains with Peter Hydorn Photography.

Purchase of photography services, digital files, prints, or other products does not automatically transfer copyright ownership to the client.

Copyright remains separate from the client's licensed right to use delivered material.

11. Client Usage & Licensing

The client's permitted use of photographs or video depends on the agreement associated with the project.

Personal-use licensing generally permits the client to use delivered images for personal purposes.

Commercial usage, advertising, promotional campaigns, publication, resale, product packaging, third-party licensing, or other commercial applications may require additional licensing.

Clients may not sell, sublicense, transfer, or commercially exploit licensed images beyond the agreed usage without written permission.

12. Commercial Projects

Commercial clients may receive usage rights based on the scope, duration, territory, media, and intended purpose of the project.

Commercial licensing fees may be separate from photography or production fees.

Where applicable, the final license will be documented in the project proposal, invoice, contract, or licensing agreement.

13. Portfolio & Promotional Use

Unless otherwise agreed in writing, Peter Hydorn Photography reserves the right to display completed photography, video, and creative work in portfolios, websites, social media, exhibitions, promotional materials, competitions, publications, and other self-promotional contexts.

Clients who require confidentiality, embargoes, or restrictions on promotional use must request those terms before the project begins.

14. Client-Provided Materials

Clients are responsible for ensuring that they have the legal right to provide any photographs, video, logos, music, trademarks, documents, or other materials supplied to Peter Hydorn Photography.

The client agrees to hold Peter Hydorn Photography harmless from claims arising from unauthorized use of client-provided materials.

15. Fine-Art Prints & Limited Editions

Fine-art prints and limited-edition artwork are produced according to the specifications listed at the time of purchase.

Limited-edition works may be signed and numbered and produced only in the stated edition quantity.

Once an edition is sold out, Peter Hydorn Photography may discontinue production of that specific edition.

Colors and appearance may vary slightly between digital displays and physical prints due to differences in screens, materials, printing processes, and lighting conditions.

Custom print orders may not be returnable once production has begun, except where required by applicable law or when a product arrives damaged or defective.

16. Custom Wall Art

Photographs created during any Peter Hydorn Photography session may be eligible for custom printing and wall-art production.

Available materials, sizes, finishes, and presentation options may vary by image and supplier.

Custom artwork is produced according to the specifications approved by the client.

Once a custom order has entered production, changes or cancellations may not be possible.

17. Third-Party Printing & Production

Peter Hydorn Photography may work with professional third-party laboratories and production partners, including WhiteWall, for printing and wall-art fulfillment.

While reasonable care is taken in selecting professional production partners, Peter Hydorn Photography is not responsible for delays caused by third-party production or shipping providers.

Any damaged or defective product should be reported promptly so that the appropriate remedy can be evaluated.

18. Travel & Additional Expenses

Projects outside the standard service area may be subject to travel fees, mileage, lodging, parking, permits, equipment transportation, or other reasonable production expenses.

Any applicable travel or production expenses will be communicated to the client when possible before the project begins.

19. Client Cooperation

Clients are responsible for providing accurate project information, access to locations, necessary permissions, schedules, contact information, and other materials required to complete the work.

Peter Hydorn Photography is not responsible for delays or incomplete deliverables resulting from inaccurate information, lack of access, client delays, venue restrictions, or circumstances caused by the client or third parties.

20. Events & Venue Restrictions

Clients are responsible for notifying Peter Hydorn Photography of venue rules, photography restrictions, access limitations, parking requirements, credentialing requirements, or other restrictions that may affect the work.

Peter Hydorn Photography will make reasonable efforts to work within venue requirements but cannot guarantee specific photographs or footage when access or restrictions prevent them.

21. Force Majeure

Peter Hydorn Photography will not be liable for failure or delay caused by circumstances beyond reasonable control, including severe weather, natural disasters, fire, illness, accidents, equipment failure, transportation disruption, government restrictions, venue closure, power outages, internet failures, or other unforeseen circumstances.

Where reasonably possible, the parties will work together to reschedule or find an appropriate alternative.

22. Equipment Failure & Data Protection

Professional equipment and reasonable backup procedures may be used to reduce the risk of technical problems.

However, no digital storage system, camera system, memory card, hard drive, cloud service, or backup system is completely immune to failure.

In the unlikely event that photographs or footage are lost due to equipment failure, data corruption, or circumstances beyond reasonable control, liability will be limited to the amount paid for the affected service unless otherwise required by applicable law.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Peter Hydorn Photography's liability for any claim relating to photography, video, editing, printing, or other services will be limited to the amount actually paid by the client for the affected service.

Nothing in these Terms is intended to exclude liability that cannot legally be excluded or limited.

24. Website Content

All photographs, videos, graphics, text, logos, designs, and other content displayed on this website are protected by applicable intellectual property laws unless otherwise noted.

Website content may not be copied, reproduced, modified, distributed, sold, or commercially used without written permission.

25. Website Availability

Peter Hydorn Photography makes reasonable efforts to keep the website available and accurate but does not guarantee that the website will always be uninterrupted, error-free, or free of technical issues.

Information, pricing, availability, and services displayed on the website may be changed without notice.

26. Third-Party Links

This website may contain links to third-party websites or services.

Peter Hydorn Photography is not responsible for the content, availability, privacy practices, or policies of third-party websites.

Users should review the applicable terms and privacy policies of those websites.

27. Privacy

Personal information submitted through this website may be used to respond to inquiries, process bookings, provide services, process purchases, communicate with clients, and operate the business.

28. Changes to These Terms

Peter Hydorn Photography reserves the right to update these Terms & Conditions from time to time.

The current version posted on this website will govern use of the website and services, subject to any separate written agreement applicable to a particular project.

29. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Michigan, without regard to conflict-of-law principles.

Any dispute will be handled in accordance with applicable Michigan law and the appropriate jurisdiction.

30. Entire Agreement

These Terms & Conditions, together with any applicable proposal, invoice, contract, licensing agreement, or other written agreement, constitute the understanding between Peter Hydorn Photography and the client concerning the applicable services.

Where a signed project-specific agreement conflicts with these general website terms, the project-specific agreement will control.
